      • “we”, “our” and “us” means the 25th Purley (St. Mark’s) Scout Group, operating under The Scout Association (with Registered Charity No. 306101 and registered address at Gilwell Park, Chingford, London, E4 7QW;
      • “you” and “your” means a user of the website at https://www.25thpurley.org.uk and its subdomains (the “Website”).
    • These Terms of Use set out the terms and conditions on which we agree to make available and you agree to access and use the Website.

    • We may amend these Terms of Use from time to time. If we do, we will publish the changes on the Website. Please review the Website periodically for changes to these Terms of Use. The amended Terms of Use will take effect 30 days from the date on which we publish the amendments on our Website, and from then on will govern the relationship between you and us in respect of your use of the Website.   1. Account and Registration
    • You must be a member of the 25th Purley (St. Mark’s) Scout Group to register for a my25th account on the Website. You will be provided with a username and password for you to log in. It is strongly recommended that you change the password to your account on a regular basis.
    • You must not allow any other person to use your my25th account to access any part of the Website, including payment for camps, courses, equipment, clothing, subscriptions or any other offerings.
    • You must notify us immediately in writing if you become aware of any unauthorised use of your account.
    • We may suspend, cancel or edit your account details at any time in our sole discretion.

    • If you are under 18 years old, you must obtain permission from a parent or guardian before using any part of the Website.

    • We employ the use of cookies. By accessing the Website, you agree to the use of cookies in agreement with the Privacy Policy.

  2. E-Commerce
    • Members have the opportunities to pay for certain services within Scouting at the 25th Purley (St. Mark’s) Scout Group including payment towards subscription costs, uniform, camps and courses. Such payment shall be made securely and in accordance with applicable regulation. You acknowledge, however, that by placing an order you have read and accepted this Terms of Use.
    • Payment is only accepted in pounds sterling and is due at the time of an order.
    • For each offering to which you may make a payment, we will make clear to you a description, the total cost, payment option.
    • You have 14 days from the date of payment (and the date on which you enter into the contract with us) to cancel. In order to do so, please contact [email protected]

  3. Legal disclaimer
    • Nothing in these Terms of Use is intended to exclude or limit our liability for death or personal injury caused by our negligence, for fraudulent misrepresentation or for any other liability that cannot be excluded or limited by law.
    • Save as expressly provided in these Terms of Use, the Website is made available to you on an “as is” basis and we disclaim and do not accept any liability to you in respect of it or otherwise. It is your responsibility to ensure that the Website is suitable for your intended purposes.  We accept no liability as to the suitability or fitness of the Website in meeting your needs and we exclude to the fullest extent permissible by law all express or implied warranties, representations, conditions or terms, including, without limitation:
      • that access to the Website will be uninterrupted or error-free;
      • that the Website or the computer server from which the Website are made available, are free of viruses or other harmful components; and
      • to the accuracy, content, timeliness, completeness, reliability, quality or suitability of any content contained in or delivered via the Website or otherwise made available in connection with the Website.
    • We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control. You accept that we have an interest in limiting the personal liability of our officers, volunteers and having regard to that interest you acknowledge that you will not bring any claim personally against our officers or volunteers in respect of any losses you suffer in connection with the Website, its use or these Terms.
    • You also acknowledge and agree that the operation of the Website is dependent upon the proper and effective functioning of the internet and other third party equipment and services, and that we do not guarantee and will not be liable for these in any way.
    • Subject to Clause 1, we will not be liable to you for any special, indirect or consequential losses or damages, or any loss of data, profits, revenues, business, or goodwill.
    • You agree to indemnify the 25th Purley (St. Mark’s) Scout Group, its directors, officers, employees, volunteers immediately on demand, against all claims, liability, damage, cost and expense, including legal fees, arising out of any breach of the terms of this Terms of Use.
    • Notwithstanding the above, the limitation of liability for the 25th Purley (St. Mark’s) Scout Group to you shall be capped at an aggregate of £100.

    • Unless otherwise stated, the 25th Purley (St. Mark’s) Scout Group and/or its licensors own the intellectual property rights for all material on the Website. All intellectual property rights are reserved. You may access the Website for your own personal use subject to the restrictions set forth in this Terms of Use.
    • You may not copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available or otherwise use the Website or its content in any way except for your own personal non-commercial use or in a non-commercial use directly related to Scouting in the UK. You agree not to adapt, alter or create any derivative work which requires the prior written consent of the 25th Purley (St. Mark’s) Scout Group.

  5. Severability
    • If a provision of this Terms of Use is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in full force and effect. If any unlawful and/or unenforceable provision of this Terms of Use would be lawful or enforceable if part were deleted, that part will be deemed to be deleted and the rest of the provision will remain in effect.

    • This Terms of Use is for our and your benefit and is not intended to benefit or be enforceable by any third party.

    • This Terms of Use and any dispute or claim arising out of or in connection with this Terms of Use or its subject matter or formation (including non-contractual disputes or claims) are governed by and shall be construed in accordance with English law.
    • The parties submit to the exclusive jurisdiction of the English courts for all purposes relating to and in connection with this Terms of Use and any such dispute or claim referred to in Clause 14.1.
